Someone opened their car door into mine — whose insurance should pay?

What should you do?
- Photograph both vehicles, the damage and their positions if possible.
- Take the other person's name, registration and insurance details.
- Obtain witness details if anyone saw what happened.
- If the other person disputes responsibility, provide the evidence to your insurer.
What can make a difference?
The result can depend on your level of cover, exclusions, excess, information given when the policy was arranged or renewed, who was driving, and the precise circumstances. Two policies both described as “comprehensive” can still contain different terms.
Do not assume liability is automatic simply because the damage is on the side of your car; the facts still matter.
If another person caused the damage, their motor insurer may ultimately be involved, but evidence matters. Photograph the damage, exchange details where possible and notify your own insurer in accordance with your policy.
