Short answerWith comprehensive cover, you may be able to claim under your own policy. A claim against the property owner normally depends on whether they were legally responsible, not simply on the fact that the tile came from their building.

What should you do?

  • Photograph the car, tile and building before anything is moved if safe to do so.
  • Record weather conditions and any obvious state of disrepair.
  • Get the property owner's or occupier's details.
  • Your insurer may consider recovery from another party if there is evidence of negligence.

What can make a difference?

The result can depend on your level of cover, exclusions, excess, information given when the policy was arranged or renewed, who was driving, and the precise circumstances. Two policies both described as “comprehensive” can still contain different terms.

An owner is not automatically liable for every tile that falls, particularly during exceptional weather.

The property owner may not automatically be liable

A falling tile does not necessarily mean the property owner was negligent. Your own comprehensive policy may cover accidental damage, while any claim against the owner can depend on why the tile fell and whether a known defect had been ignored.
